Terms of Service
Last updated: 9 October 2026
Welcome to RackStar. These Terms of Service ("Terms") govern your use of the RackStar application and related services (collectively, the "Service") operated by NV-IT, Trutseleir 35, 9220 Hamme, Belgium, VAT BE1012827973 ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.
1. Acceptance of Terms
By creating an account or using RackStar in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
You must be at least 13 years of age to use RackStar. If you are under the age of majority where you live, you need permission from a parent or legal guardian to use the Service. We do not knowingly collect personal information from children under 13, and if we learn that we have, we will delete the associated account and data. If you believe a child under 13 is using RackStar, please contact us at support@rackstar.app. When you accept these Terms in the app, you are asked to confirm that you meet this age requirement.
2. Account Creation and Responsibility
To use RackStar, you must create an account using a supported authentication provider (Google, Microsoft, or Apple) or by registering with an email address and password. When creating an account, you agree to:
- Provide accurate and complete information.
- Maintain the security of your account credentials.
- Accept responsibility for all activities that occur under your account.
- Notify us immediately of any unauthorized use of your account.
You are solely responsible for maintaining the confidentiality of your authentication credentials. We are not liable for any loss or damage arising from your failure to protect your account.
3. Acceptable Use
You agree to use RackStar only for its intended purpose and in compliance with all applicable laws. You must not:
- Use the Service for any unlawful or fraudulent purpose.
- Attempt to gain unauthorized access to other users' accounts or data.
- Interfere with or disrupt the Service or its infrastructure.
- Upload or transmit malicious code, viruses, or harmful content.
- Use automated systems (bots, scrapers) to access the Service without permission.
- Harass, abuse, or threaten other users through the Service.
- Manipulate game scores, statistics, or leaderboard rankings dishonestly.
- Impersonate another person or entity.
- Use the Service to send spam or unsolicited messages.
4. Intellectual Property
The RackStar application, including its design, code, graphics, logos, trademarks, and all related content, is the exclusive property of NV-IT and is protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not:
- Copy, modify, or distribute any part of the Service.
- Reverse engineer, decompile, or disassemble the Service.
- Remove or alter any proprietary notices or labels.
- Use the RackStar name, logo, or branding without prior written consent.
5. Subscriptions, Purchases and Refunds
RackStar offers optional paid memberships and club subscription plans. These are sold as auto-renewing subscriptions through the Apple App Store or Google Play, depending on the platform you use. The price and billing period are shown before you confirm a purchase, and you are charged at confirmation of purchase or, if you start a free trial, when the trial ends.
Subscriptions renew automatically at the same price and for the same period unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel a subscription at any time in your Apple ID account settings or your Google Play subscription settings. Free trials, where offered, automatically convert into a paid subscription at the end of the trial unless cancelled before the trial ends.
We also offer one-off point packs. These are consumable digital content that is delivered to your account immediately upon purchase.
Refunds for any purchase are handled by Apple or Google under their respective refund policies, as RackStar does not process payments directly or hold your payment details. If you are an EU consumer, you generally have a statutory right of withdrawal for digital content. By requesting immediate delivery of a point pack or subscription benefit, you consent to immediate performance and acknowledge that you lose your right of withdrawal once delivery begins, to the extent permitted by applicable law. Nothing in this section affects any statutory consumer rights you may have that cannot be waived by agreement.
6. User Content
You may submit content through the Service, such as comments during games, display names, profile information, and uploaded images -- including club or tenant logos and custom avatars uploaded by club admins ("User Content"). By submitting User Content, you:
- Retain ownership of your User Content.
- Grant us a non-exclusive, worldwide, royalty-free license to use, display, and store your User Content as necessary to operate the Service.
- Represent and warrant that you hold the necessary rights to submit such content (including any uploaded images) and that it does not violate any third-party rights, including copyright.
We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, at our sole discretion.
7. Game Data and Statistics
Game scores, statistics, and leaderboard data are generated through your use of the Service. While we strive for accuracy, we do not guarantee that game data will be error-free. We reserve the right to correct or adjust game data if errors are discovered.
8. Service Availability
We aim to keep RackStar available at all times, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to:
- Scheduled maintenance and updates.
- Unexpected technical issues or outages.
- Circumstances beyond our control (force majeure).
We are not liable for any loss or inconvenience caused by Service downtime.
9. Limitation of Liability
To the maximum extent permitted by applicable law, NV-IT and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Loss of data, profits, or business opportunities.
- Service interruptions or errors.
- Unauthorized access to your account.
- Any conduct or content of third parties on the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Account Termination
We reserve the right to suspend or terminate your account at any time if:
- You violate these Terms of Service.
- Your account is used for fraudulent or illegal activity.
- We are required to do so by law.
- We discontinue the Service (with reasonable notice).
You may also request deletion of your account at any time by contacting us at support@rackstar.app. Upon termination, your right to use the Service will immediately cease, and we may delete your data in accordance with our Privacy Policy.
11. Indemnification
You agree to indemnify, defend, and hold harmless NV-IT and its officers, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of or related to your use of the Service or violation of these Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Belgium.
13. Changes to Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by updating the "Last updated" date at the top of this page. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically to stay informed about the conditions governing your use of RackStar.
14. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
15. Copyright and Takedown Notices
We respect the intellectual property rights of others. If you believe that content available through RackStar infringes your copyright, you may send a notice to support@rackstar.app with the subject line "Copyright notice". Your notice should include:
- Identification of the copyrighted work you claim has been infringed.
- The URL or location within the app where the allegedly infringing material appears.
- Your contact details (name, address, email, and phone number).
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
We will act expeditiously on valid notices, which may include removing or disabling access to the material and notifying the user who uploaded it. Where applicable, that user may submit a counter-notice disputing the removal. We may terminate the accounts of users found to be repeat infringers.
You can also use the in-app "Report" feature on comments, chat messages, and images to flag content for review without sending a formal copyright notice.
